The First Few Hours: From Arrest to Booking

When someone is arrested in Miami-Dade County, they are taken to a local booking facility, often the Turner Guilford Knight Correctional Center (TGK). This is the start of a standard administrative process.

During booking, the person will have their fingerprints and photograph taken, and their personal information will be recorded. Their personal belongings are collected and stored for safekeeping until their release.

It's important to know that this process is not instant. It can take several hours for a person to be fully processed into the system. This waiting period can be stressful, but it's a normal part of how the system operates.

While your loved one is being booked, they are going through a routine procedure. Once they are in the system, we can begin the process of finding them and arranging for their bail.

How is the Bail Amount Determined?

Bail is simply a financial guarantee that a person will return for their court dates after being released from jail. It's not a punishment or a fine.

In Miami-Dade County, many common offenses have a pre-set bail amount listed on a 'standard bond schedule.' If the charge is on this schedule, a person can be bonded out relatively quickly without needing to see a judge.

For more serious charges, or ones not on the schedule, the person must attend a 'first appearance' hearing. This usually happens within 24 hours of the arrest. A judge will consider the nature of the charge, the person's ties to the community, and their past record before setting a bail amount.

The amount set by the judge or the schedule can seem high, but you typically do not have to pay the full amount to get your loved one released. This is where a bail bond becomes the most common solution.

Your Two Main Options for Posting Bail

Once bail is set, you generally have two options. The first is to pay a 'cash bail,' which means paying the entire bail amount directly to the court clerk. For a $10,000 bail, you would pay the full $10,000.

While you get the cash bail money back at the end of the case (minus court fees), most families don't have that much cash readily available. This is why the second option is much more common: using a bail bondsman.

With a bail bond, you pay a bail bond company, like Faroy, a non-refundable fee. In Florida, this fee is 10% of the total bail amount for state bonds (with a $100 minimum). For that same $10,000 bail, you would pay us $1,000.

In exchange for that fee, we post a 'surety bond' with the court for the full $10,000. This bond is our guarantee to the court that your loved one will appear at their court dates. This allows them to be released for a fraction of the total cost.

What Happens After the Bond is Posted?

After you've completed the simple paperwork with us, we immediately post the bond at the jail or courthouse. Once the jail staff receives and processes the bond, your loved one is prepared for release.

Please be patient, as this final step can also take several hours. The Miami-Dade jail system is very large, and the release process involves multiple checks and procedures. The time can vary widely depending on how busy the facility is.

Once released, the most important responsibility for your loved one is to attend every single court date. Missing a court date will result in a warrant for their arrest and forfeiture of the bond.
